It covers:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Our parking services<\/strong>\u00a0\u2014 when you enter, remain in, or exit a parking facility we manage, including facilities using License Plate Recognition (LPR) cameras or CCTV, and when a parking fee or parking infringement notice (citation) is administered; and<\/li>\n\n\n\n<li><strong>The Smart Parking \u2013 Easy Parking mobile app<\/strong>\u00a0and related online services, including the payment and dispute portal at us.smartparking.com.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This policy addresses the California Consumer Privacy Act as amended by the California Privacy Rights Act (<strong>CCPA\/CPRA<\/strong>) and serves as our Notice at Collection for California residents. It should be read together with our&nbsp;<a href=\"https:\/\/smartcloud-static-content.smartsys.io\/General\/smartparking-app-terms-and-conditions.html\">Terms &amp; Conditions<\/a>&nbsp;and the parking terms posted at each facility.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Who We Are<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Smart Parking USA Inc. provides parking management technology and services at privately operated parking facilities in the United States. Privacy questions and requests can be directed to&nbsp;<a href=\"mailto:privacy@smartparking.com\">privacy@smartparking.com<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What We Do at Parking Facilities<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When you enter, remain in, and exit a parking facility we manage, LPR and CCTV cameras may photograph your vehicle and its license plate. This information is used to determine compliance with the posted parking and payment terms, to administer parking fees and parking infringement notices (citations), and to help deter and detect criminal activity.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Information We Collect<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Through our parking facilities<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Vehicle information<\/strong>: license plate number; make, model, and color; images of the vehicle captured by LPR\/CCTV cameras. Images may incidentally include occupants or bystanders.<\/li>\n\n\n\n<li><strong>Parking activity<\/strong>: entry and exit times, duration of stay, zone, and payment status.<\/li>\n\n\n\n<li><strong>Notice and payment records<\/strong>: parking fees, parking infringement notices (citations), payments, disputes, and related correspondence.<\/li>\n\n\n\n<li><strong>Registered owner information<\/strong>: where a parking fee or notice remains unpaid, we may obtain the registered owner&#8217;s name and address for the vehicle from the relevant state motor vehicle agency or from authorized data providers, or from third parties such as rental or fleet companies, where permitted by applicable law, including the federal Driver&#8217;s Privacy Protection Act (DPPA) and state equivalents.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Through the app and online services<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Phone number<\/strong>: collected through Firebase Authentication for account creation and login, and used \u2014 where you have consented \u2014 to deliver SMS account notifications (see \u201cSMS Consent &amp; Mobile Information\u201d below).<\/li>\n\n\n\n<li><strong>Parking &amp; transaction information<\/strong>: license plate, parking zone\/session details, payment transaction records, and information relating to a notice associated with your account or vehicle.<\/li>\n\n\n\n<li><strong>Device &amp; app information<\/strong>: limited technical data (device model, OS version, app version, basic diagnostics) to support security, fraud prevention, and performance.<\/li>\n\n\n\n<li><strong>Payment information<\/strong>: payments are processed by our payment providers; we do not store full payment card details on our systems.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Through the app, we do not require or intentionally collect<\/em>&nbsp;your email address, name, physical address, contact list, photos, or social media profiles.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Category<\/strong><\/td><td><strong>Examples we collect<\/strong><\/td><td><strong>Purpose<\/strong><\/td><\/tr><tr><td>Identifiers<\/td><td>Phone number, license plate, account\/session identifiers; registered owner name and address (unpaid fees\/notices only)<\/td><td>Authentication, providing the Service, administering fees and notices, account notifications<\/td><\/tr><tr><td>Commercial information<\/td><td>Parking sessions, payments, amounts payable including notices (citations), dispute records<\/td><td>Payment processing, receipts, payment reminders, dispute handling<\/td><\/tr><tr><td>Visual\/sensory information<\/td><td>LPR\/CCTV images of vehicles (may incidentally include occupants or bystanders)<\/td><td>Compliance with parking terms, evidence for fees\/notices, safety and security<\/td><\/tr><tr><td>Internet or other electronic activity<\/td><td>Device model, OS\/app version, diagnostics<\/td><td>Security, fraud prevention, performance<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Categories of Personal Information (CCPA\/CPRA)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We do not use or disclose personal information for purposes other than those described in this policy. We have not sold or shared personal information (as \u201csell\u201d and \u201cshare\u201d are defined in the CCPA\/CPRA) in the preceding 12 months.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How We Use Your Information<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Operate and manage parking facilities and determine compliance with posted parking and payment terms.<\/li>\n\n\n\n<li>Administer parking fees and parking infringement notices (citations), including pursuing unpaid amounts, resolving disputes, and defending legal claims.<\/li>\n\n\n\n<li>Authenticate and secure your app account via phone number, and process parking payments and sessions.<\/li>\n\n\n\n<li>Send you\u00a0SMS account notifications\u00a0you have consented to receive, including parking session reminders,\u00a0payment reminders, payment confirmations, and updates regarding a\u00a0notice (citation)\u00a0associated with your account or vehicle. You may opt out at any time by replying\u00a0<strong>STOP<\/strong>.<\/li>\n\n\n\n<li>Help ensure safety and security and deter\/detect criminal activity at facilities.<\/li>\n\n\n\n<li>Produce aggregated site analytics (e.g., total entries\/exits, vehicle turnover, repeat visits). We analyze overall site activity, not individual behavior; aggregated data can no longer be linked to any individual.<\/li>\n\n\n\n<li>Improve reliability, safety, and performance of our services, and comply with US legal obligations.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">We do not sell or share your personal information&nbsp;for cross-context behavioral advertising.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>SMS Consent &amp; Mobile Information<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mobile phone numbers and SMS opt-in consent data are used solely to deliver the messages described in our\u00a0<a href=\"https:\/\/smartcloud-static-content.smartsys.io\/General\/smartparking-app-terms-and-conditions.html\">Terms &amp; Conditions<\/a>: verification messages and account notifications about your parking activity, including payment reminders and updates about parking infringement notices (citations).<\/li>\n\n\n\n<li>No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.\u00a0Text messaging originator opt-in data and consent are not shared with any third parties, except with service providers (such as our SMS delivery provider) acting on our behalf solely to deliver messages to you.<\/li>\n\n\n\n<li>Message frequency varies with your account activity. Message and data rates may apply. Reply\u00a0<strong>STOP<\/strong>\u00a0to opt out or\u00a0<strong>HELP<\/strong>\u00a0for assistance at any time. Opt-out requests are honored promptly, and we retain a record of your opt-out to ensure we do not message you again.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>When We Share Information<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Your personal information may be shared with:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Service providers<\/strong>\u00a0acting on our behalf under contract: payment facilitators and processors, software and cloud hosting providers, SMS delivery providers, and print\/mail providers for notice delivery.<\/li>\n\n\n\n<li><strong>Debt recovery companies, attorneys, and courts<\/strong>, where necessary to pursue unpaid amounts or resolve disputes in accordance with applicable law.<\/li>\n\n\n\n<li><strong>Law enforcement and security services<\/strong>, to comply with law, court order, or lawful government requests, or to help deter\/detect criminal activity.<\/li>\n\n\n\n<li><strong>The facility owner or landowner<\/strong>, to assist with administration of parking management at their site (including any site whitelists they operate). They may also receive aggregated site analytics that cannot be linked to an individual. Data sharing agreements are put in place before personal data not provided by that party is shared with them.<\/li>\n\n\n\n<li><strong>State motor vehicle agencies and authorized data providers<\/strong>, to obtain registered owner details for unpaid fees\/notices as described above.<\/li>\n\n\n\n<li><strong>Business transfers<\/strong>: in connection with a merger, acquisition, or sale of assets.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Other than as listed above, we do not share information about you or your vehicle with any third party.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>How Long We Keep Your Information<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Compliant parking (no unpaid fee or notice)<\/strong>: license plate data and images are retained for up to 6 months to enable cross-referencing of registrations for discrepancies, which supports fair management of facilities (including cancelling notices where appropriate), after which they are erased.<\/li>\n\n\n\n<li><strong>Unpaid fees and notices (citations)<\/strong>: data is held long enough for the fee or notice to be settled and any dispute resolved, and not normally longer than 6 years. It may be held longer where a dispute is ongoing, a court order permits continued pursuit, or site-specific contractual or legal obligations require it.<\/li>\n\n\n\n<li><strong>Data-collection-only (managed services) sites<\/strong>: where cameras are used for data collection only and no enforcement occurs, plate data and images are retained for up to 6 months to produce site statistics, then erased.<\/li>\n\n\n\n<li><strong>App account data<\/strong>: retained as long as needed to provide the Service and for legitimate business or legal purposes; you may request deletion at any time. Records of SMS opt-outs are retained to honor your opt-out preference.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Security<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We use commercially reasonable safeguards (such as encryption and secure authentication) to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Children\u2019s Privacy<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Our services are not intended for children under&nbsp;13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, please contact us and we will delete it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>California Privacy Rights (CCPA\/CPRA)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">California residents have the following rights, subject to exceptions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Right to Know<\/strong>: request the categories and specific pieces of personal information we collect, use, and disclose.<\/li>\n\n\n\n<li><strong>Right to Delete<\/strong>: request deletion of personal information we collected about you. (Note: we may retain information where an exception applies, for example to complete a transaction, pursue an unpaid amount, resolve a dispute, or comply with a legal obligation.)<\/li>\n\n\n\n<li><strong>Right to Correct<\/strong>: request correction of inaccurate personal information.<\/li>\n\n\n\n<li><strong>Right to Opt Out of Sale\/Sharing<\/strong>: we do not sell or share your personal information for advertising.<\/li>\n\n\n\n<li><strong>Right to Limit Use of Sensitive Personal Information<\/strong>: we do not use or disclose sensitive personal information for purposes requiring a right to limit.<\/li>\n\n\n\n<li><strong>Right to Non-Discrimination<\/strong>: we will not discriminate against you for exercising your rights.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">To exercise your rights, email&nbsp;<a href=\"mailto:privacy@smartparking.com\">privacy@smartparking.com<\/a>. You may use an authorized agent; we may require proof of the agent&#8217;s authorization. We will verify your identity before acting on a request (for example, by confirming control of your phone number or matching vehicle and notice details) and will respond within the timeframes required by law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Residents of other states with comprehensive privacy laws may have similar rights under their state&#8217;s law; requests can be submitted through the same contact and will be honored as required by the applicable law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Disputing a Notice<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If you wish to dispute a parking fee or parking infringement notice (citation), please follow the instructions on the notice or use the dispute option at&nbsp;<a href=\"https:\/\/us.smartparking.com\/\">us.smartparking.com<\/a>. Information you provide during a dispute will be used to review and resolve it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Third-Party Services<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Firebase Authentication (Google)<\/strong>\u00a0for phone number sign-in and account security.<\/li>\n\n\n\n<li><strong>Payment processors<\/strong>\u00a0for handling parking payments (card data is processed by the provider).<\/li>\n\n\n\n<li><strong>SMS delivery providers<\/strong>\u00a0for transmitting verification and account notification messages.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For information about how these providers handle data, please review their respective privacy notices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Changes to This Privacy Policy<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We may update this Privacy Policy from time to time. We will post the updated policy in the app and on our website and revise the \u201cLast updated\u201d date above.
