All appeals must be made in writing, and you should include the Breach Notice reference, your car’s licence plate, and as much information as possible about the reason for your appeal, including any supporting documentation (i.e. a receipt to prove expenditure).

If we do not receive correspondence from you within 21 days, we will issue a Breach Reminder Notice, which will include an additional administration fee on top of the original Breach Notice amount.

If you have not contacted us within 35 days of the date of the first Breach Notice, your details will be passed to a debt collection agency, with additional fees applicable.

If you have not received a reply within ten (10) working days, please check your junk or spam email folder, as our responses can sometimes be redirected there.

If you appeal within 21 days of the first Breach Notice, we will suspend the amount until we have responded to your appeal and provided an outcome. If the appeal is rejected and the Breach Notice has not been paid by the due date, the fee will increase as indicated in the letter you received.

If you appeal after 21 days and your appeal is unsuccessful, you will be liable for the original Breach amount plus an additional administration fee. If we receive no correspondence from you within 35 days of the date of the first Breach Notice, your details will be passed to a debt collection agency, with additional fees applicable.

If your appeal is unsuccessful and no payment is received within 14 days of the decision, your details will be passed to a debt collection agency, with additional fees applicable.

Car park abuse is detrimental to landlords, business owners, and tenants. Smart Compliance Management provides a service that ensures the efficient and regulated use of car parks.

All Smart Compliance Management private parking sites have signage displaying the facility’s Terms and Conditions, as well as other signage with important information that can include:

• Time limit restrictions
• Authorised parking restrictions
• Paid parking terms and tariff information

All signage on site complies with regulatory and legislative requirements. Always read the signs carefully to understand the rules before you park.

A Breach Notice may have been issued because a valid paid parking permit was not displayed. There are multiple reasons this may have occurred:

• Vehicle registration was entered incorrectly – for example, plate ABC123 was entered as ACB123.
• Payment was made late – the vehicle was parked in the facility for longer than a reasonable period before payment was made.
• The payment permit was overstayed – the payment made was insufficient for the time spent parked. For example, the motorist paid for one hour of parking, but the vehicle remained parked for longer without further payment.
• Payment for the site was not made correctly – a council or third-party payment app was used to pay for parking inside the car park, with parking enforcement overseen by Smart Compliance Management.

Yes. Smart Compliance Management has the written authority from the authorised party to operate and issue Breach Notices. Smart Compliance Management voluntarily follows the guidelines in the Code of Practice for Parking Enforcement on Private Land, which provides recommendations for parking enforcement on private land.

Rules for parking your vehicle on private property (such as private car parks or retail car parks) are set by the property owners and displayed on the signage in the car park. By entering the car park, you enter into a contract to comply with the Terms and Conditions of parking, as displayed in the car park. If a motorist breaches the Terms and Conditions of parking, Smart Compliance Management can issue a Breach Notice.

Smart Compliance Management is accredited to use the NZTA Motochek database to request the registered owner’s details to issue Breach Notices to vehicles that have failed to comply with the advertised Terms and Conditions.

To ensure fairness, we apply short grace periods before issuing a notice. These allow reasonable time for:

• Before payment, read the signs, decide whether to stay, and pay.
• After paid time has expired, return to your vehicle and exit.
• Once the time limit is reached, a short buffer is added to cover delays, such as loading or internal traffic.

Registered ownership details are provided to Smart Compliance Management by the NZTA, pursuant to section 241 of the Land Transport Act 1998, when a vehicle is parked in breach of the terms and conditions of a private car park. To request this information, Smart Compliance Management (a division of Smart Parking Limited) is accredited to access the NZTA Motochek database, as per Gazette Notice 2025-au4281.

The CSS Disability Action scheme for disabled drivers allows permit holders to park in accessible car parks (displaying the wheelchair symbol), standard car parks, and metered spaces for longer than the stated time limits. This applies only to public roads and not to private land.

No. We issue Parking Breach Notices, which are contractual breach fees.

Some publications and social media suggest that only liquidated damages are enforceable. This is incorrect. Case law and Tribunal decisions confirm that contractual breach fees are valid and enforceable.

It depends on the car park’s rules. You might need to register your number plate on a tablet if the car park rules require it.  Please read the signs.

Depending on the car park’s terms and conditions, a free parking period may be available. This time limit is clearly displayed on the signs in the respective car park.

Payment must be made before exiting by entering your number plate through the chosen method. Options differ by operator but typically include:

• via a payment machine in the car park
• via a parking app
• via a parking tablet

This means the system couldn’t find a valid payment or validation for your number plate, or you exceeded the free parking period.
